1. Acceptance of Terms

By accessing or using CutList Creator ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

CutList Creator is an online tool that generates cutting lists for built-in cupboards, wardrobes, and kitchen cabinets. Users select cabinet units from a catalogue, customise dimensions and materials, and export detailed cutting lists in Excel format. The Service also provides hardware lists, build sketches, and project management features.

3. Account Registration

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.

4. Subscriptions and Payments

Free Trial: New users may be eligible for a free trial period. During the trial, you have access to the cutting list tool and may save your first project. Exports are available on the first project only. The trial period and its terms are displayed at the time of registration.

Paid Plans: Paid subscriptions (monthly, annual, or 24-month) unlock additional features including the ability to save and manage projects. Subscription fees are displayed on the pricing page and are charged at the time of purchase.

Payment Processing: Payments are processed through Yoco. By making a payment, you agree to Yoco's terms of service.

Renewals: Monthly and annual subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription from your Account settings at any time.

Refunds: Subscription fees are generally non-refundable. If you cancel a subscription, your access continues until the end of the current billing period. No partial refunds are provided. In exceptional circumstances, refund requests may be considered on a case-by-case basis by contacting us.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service
• Reproduce, distribute, or resell the Service or any content generated by it without permission
• Use automated tools (bots, scrapers) to access the Service without our written consent
• Share your account credentials with third parties or allow multiple users to access a single account

6. Cutting List Disclaimer

The cutting lists, dimensions, hardware quantities, and other outputs generated by the Service are provided as a guide only. While the calculations are based on standard cabinet construction methods and proven formulas, you are solely responsible for verifying all measurements, quantities, and specifications before cutting any materials or purchasing any hardware.

CutList Creator does not guarantee the accuracy, completeness, or suitability of any cutting list for your specific project. Variations in board thickness, manufacturing tolerances, installation conditions, and other factors may affect the final result. Always measure twice, cut once.

We are not liable for any material waste, rework costs, project delays, or other damages arising from the use of cutting lists generated by the Service.

7. Intellectual Property

All content, design, code, graphics, logos, and other materials on the Service are the property of CutList Creator or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

Cutting lists and project data you create using the Service are yours. We do not claim ownership of your project data, but we retain the right to store and process it as necessary to provide the Service.

8. Limitation of Liability

To the maximum extent permitted by law, CutList Creator and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or materials, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

10. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Use or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately, and we may delete your account data after a reasonable retention period.

11. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
